Every pick-up and or drop-off out of the business hours will be charged at 20 Euro for additional hour.
Deposit
A security deposit of, depending on the model of motorcycle, must be paid at the beginning of the motorcycle rental period. The deposit will be held until the undamaged motorcycle is returned in condition as it was before rental. The deposit will be refunded at that time. We accept deposit in cash.
Price does not include
All items not listed as included!
Not allowed
– Driving under the influence (DUI) of alcohol and drugs or any other substance that could affect normal concentration skills also as dangerous or careless driving.
– Lending the bike to other people, not authorized in the contract, non-valid license holders, and non-capable drivers or not in a proper state to drive.
– Off-road driving, racetrack driving (unless otherwise is stated).
The customer must bear losses arising from unauthorised driving in full and without self-insured retention.
Possible changes at arrival: vehicle, make or model
Due to unforeseen circumstances such as, mechanical failures, theft or other unexpected circumstances, occurred after the reservation took place, could cause that we will not be able to satisfy the category, make or model chosen, or any other contracted services, even with the reservation confirmed.
We will make all effort possible, to assure the assigned bike delivery or other with similar characteristics or of a higher category at the same price. If that is not possible, and a lower category bike is delivered, the value difference will be refunded. Only if the substitute bike is not accepted, we will refund 100% rent fee back to the customer and the legal contract will be cancelled. This is on the understanding that no reclamation will be held against us.
Responsibility
We are not responsible or liable for any accidents. Furthermore, it is agreed and understood, that we are not the guardians of any customer’s safety and they, individually or collectively, cannot be held liable in any way for any occurrence in connection with the operation or the client’s participation, which might result in injury, death, or other damage to the client, his property, or his family, heirs, or assigns. We are not responsible or liable for a delay occurring from the manufacturers failure to deliver the motorcycles on time.
The customer is liable in any case for all personal injuries and damage to property caused by his/her intentional misconduct or negligence and shall indemnify and hold us harmless against all third party claims asserted directly on our company (Europe Moto Tours) in connection with such injuries and/or damage. Damage caused by customer’s intentional misconduct or negligence means in particular (but not limited to) damage attributable to driving mistakes, lack of driving ability and/or disorderly driving behaviour (for instance, driving on the back wheels, making a racing start, failing to comply with safety spaces between vehicles etc.).
Obligations and Liability of the Renter (Europe Moto Tours)
The renter shall hand over the motorcycle in a technically correct and road-safe condition. The Hirer shall additionally receive the vehicle documents and tools. The Renter shall recognize and accept existing damage only if it is defined in writing in the damage form as part of the handover procedure. If, through no fault of the Hirer, a repair is necessary during the rental period in order to ensure operation or maintain road worthiness of the motorcycle, the Hirer must receive the Renter’s consent before proceeding with the repair. Further claims, irrespective of whatever legal reason, are excluded unless the damage or loss to the Hirer is attributed to intent or gross negligence on the part of the Renter.
Liability of the Hirer for Damage
From the moment of transfer through to return of the motorcycle, the Hirer shall be liable to the Renter even for the slightest negligence/carelessness in terms of the demise (including the loss or confiscation) of the motorcycle as well as for all damage (such as accident or operational damage, damage as the result of improper use and damage that reduces the value of the motorcycle) that occurs beyond the scope of normal wear of the motorcycle during the rental period. In the case of damage to the rental motorcycle, the Hirer shall be liable for the costs of repair, invoicing and return actually incurred or defined by an expertise appraisal as well as for the costs of expertise, the reduction in technical and market value up to the amount of the damage deductible.
Requirements in the Event of Accident or Any Other Damage
If damage or loss occurs, as well as in the event of damage or accident, the Hirer shall be obliged to notify the Europe Moto Tours immediately by telephone (+386 40 299 195). Towing and/or repair services are to be called in only after obtaining the consent of us. The police must be notified immediately in the event of an accident. Evidence (witnesses, track marks, etc.) is to be secured, the personal data of those involved recorded and everything must be done that can contribute to correct and complete clarification of the sequence of events.
Insurance Cover
The hirer agrees to assume financial responsibility in case of damage to the motorcycle. The Hirer is expressly reminded that, despite fully comprehensive liability insurance, he/she is still liable for damage in the following cases:
– If he/she does not comply with the provisions of the contractual agreement.
– Leaves the site of an accident he/she was involved in.
– Causes damage intentionally, deliberately or through gross negligence.
– Exceeds the agreed rental period contrary to the terms of the agreement.
Insurance included in the price of the rental
– Full coverage vehicle insurance in case of damage, accident, fire or theft, with deductible. Which means the driver of the vehicle is responsible for paying 500 EUR or 800 EUR (depends on motorcycle model) of the costs incurred from damages or the total loss of the vehicle.
– Full coverage third party insurance in case of an accident.
Tyre puncture If you get a puncture in a rental motorcycle, it’s likely that it would be during your trip and whatever it might end up costing, you’ll still want to get it repaired or replaced so you can carry on your journey.
If you do have a puncture (nail / screw / foreign object in the tyre), if may be that it can be repaired rather than replaced. A tyre repair centre will advise if a repair is possible. The tyre must be the same specification as damaged tyre. Unfortunately the cost of the tyre repair is not covered and you will be fully charged. Furthermore, if the tyre is fixed with a temporary solution, you will be charged for replacing the tyre at the end of the rental period for safety reasons.
For your personal safety we strongly recommend taking out a personal accident insurance.
These clauses may cease to have validity in the following cases
– Vehicle is driven under the effects of alcohol, drugs, narcotics or other psychoactive substances.
– Vehicle is driven in places not authorized by the rental company, in this case, off-road, forest tracks, any non-paved roads or on a race track.
– Vehicle is driven by unauthorized person.
